Terms of Service

These Terms of Service (the "Terms") govern your use of Divehouse (the "Service"), operated by divehouse, LLC, a Texas limited liability company with offices at 6901 S. Custer Rd, McKinney, TX 75070, USA ("Divehouse", "we", "us"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
The Service is intended for users in the United States.
1. eligibility
You must be at least 16 years old to use the Service. By creating an account or otherwise using the Service, you represent that you are 16 or older.
2. your account
We use passwordless, email-code sign-in. You're responsible for safeguarding the email address used to access your account, and for any activity under your account. Provide accurate information when you sign up and keep it current.
3. what Divehouse is
Divehouse is a live-music discovery app. It helps you find artists, tracks, and shows, follow the acts you like, and play music through a connected music service. Information about artists, releases, and events may be provided by third parties or sourced from third-party catalogs; we don't guarantee that it is complete, current, or accurate.
4. music services
Full-track playback is provided through third-party music services that you choose to connect (currently Apple Music; Spotify coming soon). Your use of those services is governed by their own terms and privacy policies, and an active subscription (for Apple Music) or Premium account (for Spotify) may be required for full playback. Divehouse is not affiliated with, endorsed by, or responsible for those services, and we don't control the music catalogs or playback they provide.
5. user content & licenses
You retain ownership of content you provide (such as your profile photo, username, and bio). By providing content, you grant Divehouse a non-exclusive, worldwide, royalty-free license to host, display, and use that content as part of operating and providing the Service.
You are responsible for the content you provide. You represent that:
- You have the right to share it
- It does not infringe anyone's rights (including copyright, trademark, publicity, or privacy)
- It is not unlawful, defamatory, or harmful
6. acceptable use
You agree not to:
- Use the Service for unlawful purposes
- Impersonate another person, organization, or entity
- Harass, threaten, or harm other users
- Upload content that is unlawful, infringing, or harmful
- Scrape or systematically extract data from the Service
- Interfere with the Service's operation or security
- Attempt to circumvent access controls, rate limits, or paid features
We may suspend or terminate accounts that violate these rules.
7. events & listings
Where the Service shows events or shows, those are operated by the artists, venues, or promoters who put them on. Divehouse is not a party to any arrangement between you and an event organizer, and we take no responsibility for the accuracy of event details or for cancellations or postponements, except where caused by our own actions.
8. intellectual property
All Service content not provided by users (logos, design, source code, layout, copy) is owned by Divehouse or its licensors. You may not copy, modify, or distribute it without permission. The Divehouse wordmark and logo are property of divehouse, LLC.
9. communications
By creating an account, you consent to receive transactional messages such as sign-in codes. If you opt in to push notifications, you may receive alerts about shows near you and updates from artists you follow. You can turn notifications off at any time in your device settings.
10. privacy
Our Privacy Policy describes how we handle your personal information. By using the Service, you agree to the practices described there.
11. disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.
12. limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DIVEHOUSE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL.
OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID DIVEHOUSE IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
13. indemnification
You agree to indemnify and hold harmless Divehouse, its affiliates, and personnel from claims arising out of (a) your use of the Service, (b) your content, (c) your violation of these Terms, or (d) your violation of any third-party right.
14. termination
You may stop using the Service at any time and delete your account (email hello@divehouse.app to request deletion). We may suspend or terminate accounts that violate these Terms or applicable law. Sections that by their nature should survive termination (including ownership, disclaimers, limitations of liability, indemnification, and dispute resolution) will survive.
15. governing law
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws provisions. Federal law may apply where it preempts state law.
16. arbitration & class-action waiver
Please read this section carefully. It affects how disputes between you and Divehouse are resolved.
Any dispute arising out of or related to these Terms or the Service that cannot be resolved through informal negotiation (after at least 30 days of good-faith communication via hello@divehouse.app) will be resolved by binding individual arbitration administered by JAMS in accordance with its Streamlined Arbitration Rules and Procedures. The arbitration will take place in Collin County, Texas, or remotely via video conference, at the arbitrator's discretion. Judgment on the award may be entered in any court of competent jurisdiction.
You and Divehouse waive any right to a jury trial or to participate in a class action, class arbitration, or representative proceeding. Claims may be brought only on an individual basis. If this class-action waiver is found unenforceable, the remainder of this section will also be unenforceable, and the dispute will proceed in court subject to the venue provision below.
Where this arbitration clause does not apply (or is found unenforceable), disputes will be resolved exclusively in the state or federal courts located in Collin County, Texas, and you consent to personal jurisdiction there.
30-day opt-out: you may opt out of this arbitration provision by sending written notice to hello@divehouse.app within 30 days of first accepting these Terms. Your notice must include your name, the email address used for your account, and a clear statement that you wish to opt out. Opting out has no other effect on your relationship with Divehouse.
17. Apple App Store
The following applies to the Divehouse app downloaded from the Apple App Store:
- These Terms are between you and Divehouse only, not with Apple. Apple is not responsible for the app or its content.
- Apple has no obligation to provide any maintenance or support for the app.
- To the maximum extent permitted by law, Apple has no warranty obligation with respect to the app, and any claims, losses, liabilities, damages, costs, or expenses attributable to a failure of the app to conform to any warranty are governed by these Terms.
- Apple is not responsible for addressing any claims by you or any third party relating to the app, including product-liability claims, claims that the app fails to conform to legal or regulatory requirements, and claims arising under consumer-protection or similar legislation.
- In the event of any third-party claim that the app or your use of it infringes that third party's intellectual property rights, Apple is not responsible for the investigation, defense, settlement, or discharge of that claim.
- You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government restricted-parties list, and you will comply with applicable third-party terms when using the app.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
18. changes
We may update these Terms. Material changes will be communicated by email and/or in-app notice before taking effect. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.
